Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WHER website, applications, labels, and related services (collectively, the “Services”). By using the Services, you agree to these Terms. If you use WHER for an organization, you represent that you have authority to bind that organization.

Eligibility and accounts

You must be legally able to enter into these Terms and meet the minimum age required in your jurisdiction. You are responsible for accurate account information, safeguarding credentials, and activity under your account. Notify us promptly if you believe your account has been compromised.

The Services

WHER helps users record, organize, search, and share information about belongings and storage locations. WHER is a record-keeping service, not a real-time tracking or safety system. Results reflect information users provide and may be incomplete, outdated, or inaccurate. Do not rely on WHER for emergencies, hazardous-material management, or other situations where an inaccurate result could cause harm.

Your content

You retain ownership of content you submit. You grant WHER a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and otherwise use that content only as needed to operate, secure, and improve the Services and provide features you request. You represent that you have the rights needed to submit the content.

Acceptable use

You may not misuse the Services, interfere with their operation, bypass access controls, probe or attack our systems, use automated means in a way that creates unreasonable load, upload malicious code, violate another person’s rights, use the Services unlawfully, or help others do so. You may not reverse engineer the Services except where applicable law permits it.

Shared workspaces and links

If you share a workspace, label, item, or link, recipients may be able to view or change associated content according to the permissions available in the Services. You are responsible for choosing recipients and configuring access appropriately.

Paid services

Some features may require payment. Prices, billing periods, and applicable taxes are shown before purchase. Subscriptions renew automatically unless canceled before renewal, where permitted by law. You can manage cancellation through the platform or account used to subscribe. Except where required by law or stated at purchase, fees are non-refundable.

Third-party services

The Services may interoperate with third-party products. Their terms and privacy policies govern their services. WHER is not responsible for third-party products or content.

Intellectual property

WHER and its licensors own the Services, software, designs, trademarks, and related intellectual property, excluding your content. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, fail to pay applicable fees, or if required by law. Provisions that by their nature should survive termination will survive.

Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” WHER disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant uninterrupted operation or the accuracy of stored or generated results.

Limitation of liability

To the fullest extent permitted by law, WHER and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or revenues. WHER’s aggregate liability arising from the Services will not exceed the greater of the amount you paid WHER for the Services during the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

Changes

We may update the Services and these Terms. We will post updated Terms here and revise the effective date. Material changes may receive additional notice. Continuing to use the Services after updated Terms take effect constitutes acceptance where permitted by law.
